Terms of Service

SnakeSpot is operated by CIS LABS VENTURES, LLC, a Delaware limited liability company ("Company," "we," "us," or "our"). By using SnakeSpot ("the App"), you are legally agreeing to be bound by these Terms of Service. If you do not agree, do not install or use the App.

1. Purpose and Nature of Service

SnakeSpot is a community-powered snake sighting alert platform designed solely for safety awareness. It provides geospatial mapping of reports, an educational AI-based identification assistant, and local rescue contact information. THE APP IS NOT A GUARANTEE OF SAFETY. It provides community-submitted information and is not a substitute for professional medical advice, police, fire, or professional emergency rescue services.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this App. If you are under the mandatory age of majority, you must have the permission and supervision of a parent or guardian to use SnakeSpot.

3. Absolute Disclaimer Regarding Species Identification

The App utilizes advanced AI models (such as Google Gemini) to provide probability-based species identification assistance for snake photos. • THE AI IS AN ASSISTANT, NOT AN EXPERT herpetologist. It provides a probability estimate — expressed as a percentage likelihood — to assist in narrowing down possible species. It does not, and cannot, make a definitive identification. • NO IDENTIFICATION IS FINAL UNTIL A PROFESSIONAL HAS ATTENDED. The species of any snake cannot be confirmed with certainty until a registered, qualified snake handler or licensed herpetologist has physically attended the scene and made an in-person assessment. Any result provided by the App — whether from AI analysis, community reports, or reference data — is a preliminary aid only and must never be treated as a final determination. • ACCURACY IS NOT GUARANTEED. Image quality, lighting, angle, obstructions, and the natural variation in snake colouration and patterning significantly impact AI accuracy. The same species can look dramatically different between individuals, regions, age groups, and seasons. • DO NOT RELY ON THE APP FOR IDENTIFICATION. There is a meaningful risk of the AI misidentifying a highly venomous species as a non-venomous one ("false negative"). Acting on a false negative could result in serious injury or death. • TREAT EVERY SNAKE AS DANGEROUS UNTIL PROVEN OTHERWISE. Regardless of what the App displays, every snake encountered must be treated as potentially lethal until a registered professional snake handler has physically attended the scene and confirmed otherwise. Back away slowly, maintain a minimum safe distance of at least 3 metres, and do not approach, corner, provoke, or attempt to capture the snake under any circumstances. • SNAKESPOT MAKES NO CLAIM TO SPECIES ACCURACY. CIS LABS VENTURES, LLC expressly disclaims any representation that the species identified or suggested by the App is correct. The App is a community safety awareness tool, not a herpetological identification service.

4. Community Responsibility and Prohibited Conduct

You agree to use the App responsibly to help protect the community. You are solely responsible for all content (photos, descriptions, location data) that you submit. PROHIBITED CONDUCT: You agree not to: • Submit knowingly false, deceptive, or prank snake sightings ("swatting"). • Submit photos that contain offensive content, violence, or reveal the identity of persons (e.g., license plates or faces). • Harass, bully, or intimidate other users through the report summary feature. • Encourage or document harm to animals in reports. We reserve the right to remove any content or suspend accounts that violate these guidelines without prior notice. FLAGGING AND CONTENT REMOVAL: We maintain a zero-tolerance policy for objectionable content or abusive users. All submissions are automatically screened by AI moderation before they appear on the map. Our AI reviews photos to verify they contain snake-related content and scans text for profanity, harassment, and personally identifiable information — rejecting or sanitizing violating content before it is published. If inappropriate content bypasses automated screening, users may flag it via our in-app support chat or website, and we commit to removing violating content within 24 hours of a verified report.

5. Emergency Service Directive

In the event of a snake bite, or a high-danger immediate threat: • ALWAYS CALL EMERGENCY SERVICES IMMEDIATELY. • Do not attempt to catch the snake to show medics. (Instead, use SnakeSpot to report it and assist medics only if safe to do so). • Do not rely solely on the App for emergency rescue; volunteers may not be available.

6. Snake Handler Connection Service

SnakeSpot is a free community platform that connects users with independent local snake handlers. We do not charge for this connection. Any fees, travel costs, or donations requested by the handlers are negotiated directly between you and the responder. We highly encourage supporting volunteer handlers for their time and expertise.

7. Privacy Policy Integration

By using SnakeSpot, you agree to the collection and use of your data as detailed in our Privacy Policy. Your geospatial location data (GPS) is shared publicly with the community via sighting reports on the map.

8. No Warranties and Limitation of Liability

SNAKESPOT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, CIS LABS VENTURES, LLC, its members, managers, employees, contractors, and volunteers are not liable for any: • Personal injury, death, or property damage; • Emotional distress; • Direct, indirect, incidental, or consequential damages; arising from: (i) your access to or use of the App; (ii) any content submitted by users; (iii) your interaction with, or avoidance of, any snake identified (correctly or incorrectly) by the App; (iv) reliance on AI identification data; or (v) response or failure to respond by emergency services or rescue volunteers contacted through the App. YOU USE SNAKESPOT AT YOUR OWN RISK.

9. Modifications

We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Subject to the mandatory arbitration provisions in Section 12, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware.

11. Company Information

SnakeSpot is a product of CIS LABS VENTURES, LLC, a Delaware limited liability company. All rights, title, and interest in and to the App, including all intellectual property rights, are owned by CIS LABS VENTURES, LLC.

12. Dispute Resolution and Binding Arbitration

Individual Arbitration: You and CIS LABS VENTURES, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof will be settled by binding, individual arbitration, rather than in a court of law. Class Action Waiver: You and CIS LABS VENTURES, LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the arbitrator may not consolidate more than one person's claims. Administration and Venue: The arbitration will be administered virtually by the American Arbitration Association (AAA) or a mutually agreed international arbitration body under their commercial rules. To the maximum extent permitted by law, any arbitration hearings will take place remotely via videoconference or telephone. This Section is governed by the Federal Arbitration Act.

13. Sponsorship & Partnership Terms

This section applies to corporate sponsors, brand partners, and advertisers ("Partners") who purchase sponsored placement within the SnakeSpot application. All Sales Are Final: All partnership and sponsorship purchases are non-refundable. Once an invoice is paid, the campaign will be activated and no refunds, credits, or transfers will be issued for any reason, including but not limited to underperformance, change of business direction, or early cancellation requests. User Data: CIS LABS VENTURES, LLC will not share, sell, or otherwise disclose any SnakeSpot user data — including but not limited to personal information, location data, device identifiers, or usage behaviour — with Partners. Sponsored placements are geographically targeted based on anonymised aggregate location data; no individual user profiles or contact details are provided to Partners at any time. Campaign Activation: Campaigns are activated automatically upon confirmed receipt of payment. CIS LABS VENTURES, LLC does not guarantee specific impression counts, click-through rates, or conversion outcomes. Geographic targeting is delivered on a best-efforts basis and may vary based on user distribution and app usage. Creative Compliance: Partners are solely responsible for ensuring their creative assets comply with all applicable laws and regulations. CIS LABS VENTURES, LLC reserves the right to reject or remove any creative that it determines, at its sole discretion, to be misleading, offensive, or otherwise inappropriate for the SnakeSpot community.
